Whom to Sue after a Car Accident

I was involved in a car accident in rush hour traffic. I am not sure whether I should simply file a claim with the insurance company or sue the other driver. Please advise.

If you have been involved in a car accident and have suffered injuries or property damage, you may sue the driver of the other car. Suing the driver of the other car, however, will depend on a number of factors, including the laws in your state, the other driver’s insurance coverage, and whether or not the driver has insurance to cover your injuries and damages.

If the at-fault driver does not have insurance coverage, you may sue the driver personally. It is important to note that if the other driver does not have insurance, it is quite evident that he/she does not have adequate assets to pay for a lawsuit. Therefore, it is most likely that you may not recover anything.

The next option is to file a claim with your own insurance company under your uninsured motorist benefits. However, your uninsured motorist benefits cannot exceed the amount of your primary coverage.

    1. Under Connecticut law, even if you are partially at fault in a car accident, you can still bring a claim for compensation against the other driver or drivers involved in the accident as long as you are not more than 50 percent at fault. The amount of compensation you receive is reduced by the percentage that you are found to be at fault. Ref: http://www.connecticutaccident.net/practice-areas/auto-accidents/negligent-driver/

    1. A hit and run accident may involve damage to property including other automobiles or motorcycles, or stationary objects such as a telephone pole, a parked car, or a homeowner's property. It may also involve injury to a person, another driver, a vehicle passenger, a motorcyclist, or a pedestrian. It is important to hire a car accident attorney to cover the damages.
