Evidence That Can Help Your Car Accident Claim

Many people are injured or killed each day in car accidents. It is imperative that you collect evidence after an accident. Right evidence can make a big difference in recovering compensation for your injuries and other damages.

Photographs
Details of the accident scene serve as crucial evidence in a lawsuit. Make every effort to take photos of the accident scene, the vehicles involved and the injuries of those involved. You can also take photos of eyewitnesses or others involved in the accident.

Notes
Write down every detail you can remember from the accident, starting from the beginning. Do this when your memory is still fresh, as you may forget and miss out on important details.

Contact Information from all the Drivers and Eyewitnesses
Collect contact information about the drivers and their insurance companies, as well as any eyewitnesses, including their names, addresses, email information, phone numbers, license numbers, license plate numbers, insurance policy information, etc.  These will help later in your claim and in the process of proving your accident.

Police Report
The police report is one of the most important pieces of evidence in the process of filing a lawsuit. This will work as proof that the accident happened. Call the police right away and keep a copy of the police report.

Medical Report
The medical report and bills are vital evidence in making a car accident claim. Be examined medically, no matter how minor your injuries may seem at the time of the accident. Getting a medical exam proves that you were injured in the accident.

If you were injured in a car accident, contact a car accident lawyer at the earliest. A lawyer can help you in your accident claim.

Who Can Be Held Liable in a Single Car Accident?

A single car accident is an accident in which only a single car is involved. It may occur when a driver collides with a tree, building, or other obstacle. Although the driver is often held responsible for a single car accident, if the injured is able to prove that the accident was the result of some obstacle and not because of his or her fault, he or she may be able to claim damages or shift the fault elsewhere.

Situations under which others may be held liable for causing single car accidents include:

When the accident was a result of a vehicle defect
If the accident was a result of defects in the vehicle such as faulty brakes or poor alignment, the injured may be able to file a product liability claim against the manufacturer of the defective vehicle or parts.

When the accident was a result of poor road design or maintenance

How to Avoid a Car Accident?

Car accidents injure and kill thousands of people every year. Surprisingly, most of these accidents take place due to the negligence of drivers and are mostly preventable. Drivers can play an important role in preventing car accidents by staying alert and focussed while they are behind the wheels. Here are some ways to prevent a car accident:

While driving, do not indulge in any other activity such as texting or making a call, applying make-up, eating or drinking, changing the radio station or engaging in conversation with your co-passengers. All these activities may take away your attention from the road and you may not be prepared for anything ahead of you. This may result in an accident.

Constantly scan the traffic in front of you to identify any problem and give enough time to react should the driver in front of you makes a sudden stop.

Do not drive in the ‘fast’ lane because this is where most car accidents occur. Always choose to drive in the center lane to allow yourself more escape routes should a problem arise.

Do not drive under fatigue. Make sure you have had enough sleep before taking up the wheel. Driving without proper rest or feeling sleepy could result in a severe accident.

Grip the steering wheel firmly with both hands to maximize the control of your vehicle should you need to make a quick maneuver.

Familiarize yourself with how much grip your car’s tires have, the amount of time your car takes to make a stop when you apply maxim pressure to the brakes, etc. This can help you stay safe.

Maintain your car on a regular basis. Change the car’s oil and tires, have your brakes checked periodically, etc.

Who can I sue after a traffic- related car accident?

If you have been involved in a car accident have suffered injuries or property damage, you may sue the driver of the other car. Suing the driver of the other car, however, will depend on a number of factors, including the laws in your state, the other driver’s insurance coverage, and whether or not the driver has insurance to cover your injuries and damages.

If the at-fault driver does not have insurance coverage, you may sue the driver personally. It is important to note that if the other driver does not have insurance, it is quite evident that he/she does not have adequate assets to pay for a lawsuit. Therefore, it is most likely that you may not recover anything.

The next option is to file a claim with your own insurance company under your uninsured motorist benefits. However, your uninsured motorist benefits cannot exceed the amount of your primary coverage.

Who to Sue after a Car Accident?

If you have been involved in a car accident and have suffered injuries or property damage, you may be wondering if you can sue anyone for your injuries and damages. Most injured victims simply file a claim with the other party’s insurance company and negotiate. However, if your injuries are serious, you may sue the driver of the other car. Suing the driver of the other car, however, will depend on a number of factors, including the laws in your state, the other driver’s insurance coverage, and whether or not the driver has insurance to cover your injuries and damages.

Before you sue the other driver, determining who is at fault for the accident is important. If you are fully responsible for the accident, trying to sue the other driver for your own injuries or damages may not be a successful attempt. It is advisable to seek the help of a skilled lawyer. He/she can help you determine fault and also help you decide how much compensation you are entitled to, based on the percentage of your fault.

The next important thing to do before suing the other driver is to find out if the other driver has enough insurance coverage for your injuries and damages. Most states have no-fault insurance options under which insurance companies pay medical coverage regardless of which driver caused the accident.

If you have filed a claim for economic recovery to the insurance company but have not received the compensation you deserve, you can file a negligence lawsuit against the other driver for the personal injuries caused by the crash.

However, if the at-fault driver does not have insurance coverage, you may sue the driver personally.

Types of Car Accident Injuries

Car accidents can be catastrophic. They can cause severe injuries. Over 5.6 million car accidents were reported in the United States in 2012. Some types of car accident injuries are more common than others. Head and back injuries are two of the most common types of car accident-related injuries. They are also among the most serious.

Head Injuries
Hitting the head on the steering wheel, seat or window in high-speed accident can cause serious head trauma, resulting in traumatic brain injuries ranging from a mild concussion to a comatose state. The effects of the trauma can cause permanent cognitive damages.

Back injuries
Back injuries in a car accident often damage the spinal cord, causing serious nerve damage. They often occur as a result of the sudden involuntary movement to the body in a high-speed crash. They can cause numbness in the fingers, hands, arms, legs and toes. More serious spinal cord injuries can result in partial or total paralysis.

Neck Injuries
Neck injuries are common in car accidents, causing neck pain and swelling and, in some cases, temporary vocal cord paralysis. The most common neck injury is whiplash, which occurs as a result of a sudden movement of the head and neck, causing serious damage to the muscles and ligaments in the neck.

Chest Injuries
Blunt force trauma from car accidents often cause broken ribs and collapsed lungs. People with heart problems may go into traumatic cardiac arrest after a car accident. There can be immediate internal bleeding in the chest area following an accident. Damage to internal organs, the pelvis, and the abdomen also occur. In these cases, victims should be given immediate medical attention.

Other Injuries
A car accident can cause injuries to the arms, legs, hands and feet. Accidents involving pedestrians can cause leg and foot damages. Motorcyclists involved in car accidents suffer significantly more serious and more numerous injuries. The fatality rate for motorcyclists is also significantly higher than that for drivers and passengers in cars. Many people also suffer from emotional distress following a car accident.

What are the most common types of seat belt-related injuries?

The most common types of seat belt-related injuries are:

Head Trauma and Brain Injuries: These result from improper use of the mechanism, and can have serious and life changing consequences. In these cases, the seat belt is worn with the strap behind the person, which prevents the seat belt from doing what it was designed to do, with the result that the body is abruptly or violently propelled forward during the accident, with the head of the individual hitting the steering wheel, dashboard or window.

Rib and Chest Injuries:  These result from incorrectly wearing the seat belt under the arm, but they may also happen when wearing the seat belt correctly. In either event, they lead to bruised chest muscles or cracked ribs.

Seat Belt Related Injuries in Car Accidents

Seat belts are made with a mechanism that locks upon sudden movement. When high-speed accidents occur, the seat belt locks to restrict the body from hitting the dashboard or the windshield. This mechanism has saved millions of lives involved in major car accidents. At the same time, seat belts can cause injuries in car crashes. These injuries can be caused by a variety of factors, depending on the specific details of the accident. No matter what the circumstances of these injuries are, by exercising safe driving habits on the road and decreasing the number of car accidents that occur, seat belt-related accidents can be prevented.

In a car accident, the momentum of the car is immediately arrested, but the body movement of those inside continues till the seat belt forces it to stop before hitting anything in the car. This results in the seat belt gripping the body tightly, usually creating burns or bruises across the neck, chest and shoulder. Injuries commonly seen as a result of wearing the seat belt the proper way are often minor and usually consist of some bruising.
