Who to Sue after a Car Accident?

If you have been involved in a car accident and have suffered injuries or property damage, you may be wondering if you can sue anyone for your injuries and damages. Most injured victims simply file a claim with the other party’s insurance company and negotiate. However, if your injuries are serious, you may sue the driver of the other car. Suing the driver of the other car, however, will depend on a number of factors, including the laws in your state, the other driver’s insurance coverage, and whether or not the driver has insurance to cover your injuries and damages.

Before you sue the other driver, determining who is at fault for the accident is important. If you are fully responsible for the accident, trying to sue the other driver for your own injuries or damages may not be a successful attempt. It is advisable to seek the help of a skilled lawyer. He/she can help you determine fault and also help you decide how much compensation you are entitled to, based on the percentage of your fault.

The next important thing to do before suing the other driver is to find out if the other driver has enough insurance coverage for your injuries and damages. Most states have no-fault insurance options under which insurance companies pay medical coverage regardless of which driver caused the accident.

If you have filed a claim for economic recovery to the insurance company but have not received the compensation you deserve, you can file a negligence lawsuit against the other driver for the personal injuries caused by the crash.

However, if the at-fault driver does not have insurance coverage, you may sue the driver personally. It is important to note that if the other driver does not have insurance, it is quite evident that he/she does not have adequate assets to pay for a lawsuit. Therefore, it is most likely that you may not recover anything.

The next option is to file a claim with your own insurance company under your uninsured motorist benefits. However, your uninsured motorist benefits cannot exceed the amount of your primary coverage.
