My mother was
suffering from gastritis. However, she was misdiagnosed and was given
medication for a kidney problem. She was under wrong medication for about 6
months. When the medicine was not helping her, we decided to change her doctor.
It was only then that we found out that she had been misdiagnosed. The wrong
medications have worsened her condition. It has infected her liver, and she might
need to undergo surgery. We would want to recover damages for medical bills and
loss of earnings. What kinds of damages are available in such medical
malpractice cases?
You may be entitled to
recover damages for a variety of reasons, including medical bills, lost
earnings, as well as pain and suffering. However, in order for you to do so, you
must be able to prove that medical malpractice actually caused you the damages
in question. There must also be a significant price tag on those damages. There
are three different types of damages that can be recovered from a medical
malpractice case: general, special and punitive.
I consulted a doctor about my poor health. He suggested some medicines. I took the medicines for two weeks but had no improvement. Then I consulted another doctor. He told me that the medicines prescribed earlier were wrong. Can I file a claim against the first doctor?
ReplyDeleteIf your health care provider has failed to take proper care of you or a loved one, you may have a medical error claim. Doctors and hospitals owe it to their patients to be responsible and caring.

I was sick and consulted a doctor. For two weeks, I took the medicines he prescribed, but there was no improvement in my condition. In fact, I developed another disease, following which I consulted a second doctor. I was told that the medicines prescribed earlier were wrong. Can I file a claim against the first doctor or the hospital authorities for medical negligence?
ReplyDeleteWe have ve all heard stories of doctors operating on the wrong patient or a hospital staffer providing the wrong medication. Hospitals are responsible for the care and treatment of the sick and injured. You expect to be treated right. Unfortunately, mistakes on the part of hospital staff can have dire consequences. Doctors, nurses, physician's assistants, pharmacists, and hospital administrators can all make mistakes that directly affect patients. Even if the mistake was made by a single individual, the hospital may bear liability for the wrongdoing of its employee.
